I. General Terms
1. Basic provisions
- These Terms govern all contracts that you ("Customer") conclude with Plugraphics via plugraphics.com (the "Website").
- Customers are consumers unless they purchase mainly for commercial or professional purposes. Businesses are natural or legal persons acting in the course of their trade.
2. Formation of contract
- The products displayed on the Website are non‑binding catalog offers.
- You submit a binding offer by completing the checkout process and clicking “Place order”.
- We accept your offer when we send an order-confirmation e‑mail or dispatch the goods.
- If you request a manual quote, we send a binding offer that you may accept within 5 days.
3. Digital content licence
Digital files (e.g. design templates or artwork) are protected by copyright. Unless otherwise stated, you receive a non‑exclusive, non‑transferable licence for personal/business use in accordance with the agreed purpose.
4. Customised goods
- You must upload print-ready files in the specified format for customised items.
- You confirm that your content does not infringe third‑party rights or violate applicable law. You indemnify us against any resulting claims.
- We do not check your files for correctness (e.g. spelling, resolution, trademarks).
- Optional file check: We offer an optional add-on service to check your uploaded print files for basic issues such as placement within the template, visible borders or misalignment. This does not include a full design review, text proofing or legal assessment (e.g. copyright or trademark infringements). The service must be actively selected during checkout.
5. Payment methods
We offer the payment options shown at checkout (e.g. PayPal, Klarna, credit card). Unless stated otherwise, payment is due immediately upon order.
6. Retention of title
Goods remain our property until paid in full. For business customers, we retain ownership until all claims from the business relationship are settled.
7. Warranty
- Statutory warranty rights apply.
- Consumers are encouraged to report obvious transport damage as soon as possible. Failure to do so does not affect legal rights.
- Business customers must inspect goods promptly (§ 377 HGB); warranty claims expire 12 months after delivery, unless the defect was caused by gross negligence, intent or involves personal injury.
8. Right of withdrawal & returns
Consumers have no statutory right of withdrawal for the products and services offered by Plugraphics, as all physical items are personalised and made to order, and all digital services are customised to the client’s specifications. This exclusion is based on § 312g (2) 1 and § 356 (5) BGB.
The statutory 14-day right of withdrawal (§ 355 BGB) applies only to non-personalised products, if such items are explicitly marked as eligible on the respective product page.

9. Liability
We are fully liable for intent, gross negligence, injury to life, body or health, and under the Product Liability Act. For ordinary negligence, we are only liable for material contractual obligations and limited to typical, foreseeable damages.
10. Governing law & jurisdiction
German law applies, excluding the UN Sales Convention (CISG). Consumers in the EU enjoy mandatory consumer protections of their country of residence.
If you are a merchant, the exclusive place of jurisdiction is Lübeck, Germany.

2. Technical steps to conclude a contract
Outlined in section 2 above and during the checkout process. Before submitting the order, you can review and correct all entries using your browser's back function.
3. Contract language & storage
Contract language is English. The contract text is not stored permanently by us. You can print or save the order summary before placing your order. After purchase, you will receive a confirmation email with all relevant documents.
4. Prices & payment
All prices include statutory VAT and are shown in euros. Shipping costs are calculated at checkout. Customers outside the EU are responsible for applicable duties or import taxes.
5. Delivery conditions
Delivery times and restrictions are specified on the product pages and in our Shipping Policy. Risk of loss passes to consumers upon delivery; for business customers, the risk transfers once the goods are handed to the carrier.
6. Alternative dispute resolution
The EU Commission offers an Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
